    You can now add Terms of Use and Privacy Policy!

    Hi all,


    We are happy to announce that you can now add Terms of Use and Privacy Policy to the sign-up process.



    Here is how to use it:

    1. Head to the editor

    2. Create your Terms of Use & Privacy Policy pages

    3. Go to your forum page and double click on the forum

    4. Go to the settings tab and click on Member Signup Settings

    5. Click on the Policies tab and add links to the Terms of Use & Privacy Policy pages

    Tip: You can hide your policies pages from the site menu. Click here to learn how.

    Yes, the line in yellow is the entire extent of what this new feature does.

    We understand your concerns and I can tell you that we are planning to work on a new solution for the login & signup pages, which will allow more customization. Stay tuned :)

    Hello Maya, I'm facing the same issue as Ian Ippolito kindly explained here. I've had a talk with a lawyer regarding this, he said that if I'm sued by one of my forum members and the judge sees no actual agreeing(clicking the checkbox at least) from the user, I have almost zero chances to protect myself from loss.


    In other words, operating a forprofit website with no legal protection is nuts. The truth is that a comment such as "By signing up you agree with Terms and Conditions" is not legally enforceable (and Ian Ippolito had mentioned it already). People can easily say they didn't see it and the court will support them not us. Considering the number of people who do sue website owners for any possible reason, it is really hard to understand why there is still no "click-wrap method" in Wix Forum.

    Ian Ippolito, made a good point that people can still create an account by clicking "log in with Facebook" or "use your Google account" with no barrier on their way. There is nothing but little sign below that says that users agree to the policy if they sign up blah blah.. How can I rely on a sign when real lawyers say it's useless?

    I'm extremely frustrated that on the platform that specializes on the tools for people to create websites, legal protection is not thought through well. You may call any experienced lawyer and he will tell you that there is a huge problem here. What really bothers me is that Wix Store Checkout Page has this option. You can add a checkbox so people have to agree with terms and conditions before they check out and make a purchase. Here is a manual how to do it... (https://support.wix.com/en/article/adding-a-policy-checkbox-to-your-wix-stores-checkout-page). It looks like people who operate Wix Store need legal protection and us who manage Wix Forums not.


    It's been 10 months since you mentioned that you were planning to resolve this issue. Could you please make an update on what has been done to resolve this problem? Thanks,

    Hi Maya, thanks. Ok, I see what's going on now, and I understand how this feature is intended to work. A few problems/issues:


    1) I did as you recommended and clicked on "don't have an account? Sign up". Doing that did show this:




    I believe the line in yellow is the entire extent of what this new feature does. Is that correct?


    If so, there's a significant problem here, because the way this has been implemented is not legally enforceable, and is the opposite of what most attorneys recommend doing. The problem with simply putting a link to the terms of use on the page, is that any user can legitimately claim that they never saw it. So no judge will enforce this. As implemented, this feature doesn't provide the site owner any real additional protection. (See "browse-wrap method" here: https://termsfeed.com/blog/add-i-agree-terms-checkbox/)


    The proper way to do it, is to add a checkbox that says something like "I agree to the terms of use of this site", and require the user to click it to continue on. This is called the "click-wrap method" and ensures that the legal agreement is actually enforceable. If you take a look at some of the competing products, this is what they do.


    2) It looks like I was not able to effectively communicate to you that the screenshots that I took for you did not involve an existing account. They were done with a brand-new Google account that had not yet signed up on the site.


    Or to put it another way, if I am a brand-new user and come to that login screen, you guys are expecting everyone to click on the "don't have an account? Sign up" link at the bottom to create an account. However, there is a loophole. New users don't have to do that and can sign up by simply clicking on the "login with Google +" or "login with Facebook" buttons on the right to sign up/create an account. And if they do that, they never see the new terms of use notice.


    Also, this isn't a totally crazy thing for users to do, because on most sites this is a legitimate way to quickly create a new account (and in fact it currently works on Wix sites as well...although perhaps not on purpose). To me, the easy way to close the loophole is to implement the terms of use on this login page as well.

    Hi Ian,


    What you showed me is the Login page. This screen is for existing users to login to the site. We show the terms of use only in the Signup page (because these terms should be approved only once, in the signup process).


    In the image that you added, on the left side under the email and password fields, there is line says "Don't have an account? Signup". Please click on the "Signup" and you'll be taken to the Signup page.


    If you are interested you can change the settings and make the signup page be shown first.

    Maya, what I showed you is what is shown to it new user when they sign up. When a user who is new to the site, clicks on any membership protected page, wix does not allow them to actually see the page. Instead it throws up that login screen where they can choose to signup and create a new account. That is what I’m doing in the screenshots. I have never seen any other way to sign up.
